The rental agreement stipulates that no animals are allowed. Is that legal? A fixed-term tenancy agreement means that the tenant agrees to rent the premises for a fixed term. There is an end date that is in the rental agreement. For example, a tenant agrees to rent a property for six months. At the end of the agreed time, it is assumed that the tenant will move and no longer reside there. Neither a tenant nor a landlord can prematurely terminate a fixed-term lease unless the other party agrees. The necessary notifications must be sent in person or by recommended letter. Tenants must use the postal address in the “lessor`s message.” Homeowners must use the postal address of the dwellings. Can the landlord or tenant ever “break the lease”? A landlord can enter the rental premises at any time with the tenant`s consent. Consent may be given orally or in writing.

If the landlord has the tenant`s consent, no notification is required. If a tenant commits a substantial breach of the tenancy agreement, the lessor can ask the RTDRS or the court to terminate the lease or give the tenant at least 14 days` notice. The date on which the notification is issued and the day of departure cannot be included within 14 days, so the total announcement required is 16 days. If the landlord does not respond to the request within 14 days, the tenant may consider that the landlord accepts the subletting or transfer. Landlords can only increase the rent a tenant must pay under a temporary or periodic tenancy agreement after having spent at least one year (365 days) since the last rent increase or since the beginning of the tenancy. At the beginning of a rental agreement, tenants and landlords should agree on who may reside in rental housing. The names of all tenants should be included in the tenancy agreement. If a person who is not registered in the rental agreement resides in the rental houses, the owner has the right to give that person at least 14 days. If the tenant has moved, the landlord can notify the unauthorized occupant at least 48 hours in advance. There are a few organizations in Alberta that have developed leases for the Residential Tenancies Act and provided the forms for purchase.
